This Site (as defined herein) is owned by Arcee AI, Inc. (collectively, “we,” “our,” or “us,” as the context dictates). This privacy policy (this “Privacy Policy”) describes our privacy practices, the information we collect, the use, disclosure, and retention of information, including personal information you share with us on https://www.arcee.ai/ (the “Site”) and/or through the Services (as defined in the Terms of Service (as defined herein)). This Privacy Policy is intended to advise you with respect to content on the Site and the Services, as well as help you understand what information we collect through the Site or the Services (as the case may be) and how we collect it, use it, share it, and protect it. By accessing or using the Site and/or our service you agree you have read, understood, and agree to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy and our terms of service, which can be found at https://www.arcee.ai/terms-and-conditions (the “Terms of Service”).
The Information We Collect:
The personal information we receive from you depends on the context of your interactions with us, how your account is configured, and your privacy settings. Personal information we receive from you may depend on the services you use.
- Personally Identifiable Information: Use of the Site and/or the Services, as the case may be, does not require you to provide us with PII (as defined herein). In the event you provide us with PII, such PII will only be processed and used in accordance with this Privacy Policy and/or the Terms of Service. For purposes hereof, “Personally Identifiable Information” or “PII” means all personally identifying data that identifies an individual or that, in combination with any other information or data that you provide to us, or that we collect through your use of the Site, Services or otherwise that can be used to identify an individual including without limitation:
- Name
- Mailing address
- E-mail address
- Phone (or mobile) number
- Date of birth or age
- Other information that serves as answers to certain security questions
- Non-Personally Identifiable Information: Non-Personally Identifiable Information (the “Non-PII”) includes any information from which your identity is not readily ascertainable, and may include your internet protocol address, browser, operating system, pages or content you access while visiting the Site and the date and time and duration of such access. In addition to you voluntarily providing us Non-PII, Non-PII is automatically collected through the Site.
- User Content: We collect Inputs (as defined in the Terms of Service) and Outputs (as defined in the Terms of Service) as necessary to provide and improve the Services.
We automatically collect and store certain types of information about your use of our Services, including information about your interaction with our products, content and Services through the Site. Like many websites, we use unique identifiers and obtain certain types of information when your web browser or device accesses the Services. Identifiers are data that can either directly or indirectly identify an individual or link an individual to their identity.
The Use of Cookies and Tracking Technology:
To enable our systems to recognize your browser or device and to provide and improve our Services, we use cookies and other identifiers. We may collect information through the Site by way of cookies or other tracking technologies. Cookies and other tracking technologies are script files that facilitate the collection of Non-PII, such as the number of visitors to the Site, how each visitor arrived at the Site and the visitor’s use and behavior patterns on the site to ensure a better customer experience.

How We Use the Information We Collect:
We will collect and use your personal information solely for fulfilling the purposes detailed below, unless we obtain your consent or as required by law. Upon notice to us, you may discontinue use of the Site and revoke consent for the use or dissemination of your data or personal information. We may combine PII, Non-PII and information from external sources and use your information to do the following:
- communicate with you;
- provide you with our Services;
- obtain your feedback on our Site and service offerings;
- offer you additional related Services;
- statistically analyze user behavior and activity;
- advertise and deliver content relevant to your interests on the Site and third-party sites;
- provide, troubleshoot and improve our Services;
- provide chat-based methods and other methods for interacting with our Services;
- generate Outputs;
- develop, evaluate, and improve our Services;
- comply with legal obligations;
- prevent fraudulent activity;
- improve security;
- authenticate your identity when you sign-in to use our Services; and
- protect against misuse or abuse of our Services and ensure compliance with the Terms of Service and this Privacy Policy.
We may use your information to communicate with you about our Services and to give you offers and services that we think may be of use to you. You can manage your privacy and choices with respect to such communications and usage of information. See applicable use and disclosure consents.
We may use Inputs and Outputs associated with unpaid instances of our Services to train and improve our Services, unless you opt out of such use by contacting us at support@arcee.ai. Except as set forth in the following sentence or in any written agreement between you and us, we do not use Inputs and Outputs associated with paid instances of our Services to train and improve our Services. Notwithstanding any opt-out or the foregoing sentence, we will use Inputs and Outputs (whether associated with paid or unpaid instances of our Services) for model improvement if: (1) your Inputs and/or Outputs are flagged for safety review to improve our ability to detect harmful content and enforce our policies; or (2) you explicitly reported your Inputs and/or Outputs to us (for example, via our feedback or troubleshooting mechanism).
Purpose and Legal Basis for Processing your Data:
We have lawful bases to collect, use and share personal data we receive from, collect or maintain about you. Lawful bases include: (1) your consent (as provided for in this Privacy Policy, the Cookie Policy and the Terms of Service); (2) contract (where processing is necessary for the performance of a contract with you); (3) obligation to comply with laws that apply to us; (4) protection of the vital interests of a natural person, such as in the event of an emergency; and (5) other legitimate interests including, but not limited to, where processing is necessary to: (a) protect you or us from threats (such as security threats or fraud); (b) enable us to administer our business, such as for quality control and customer service; (c) manage corporate transactions; and/or (d) evaluate the use of our Services and adoption of new features to inform the development of future features and improve the Services.
Where we have a legal basis to use your personal data without consent, this Privacy Policy fulfils our duty to process personal data fairly and lawfully and in a manner that you would expect given the nature of our relationship with you, by giving you appropriate notice and explanation of the way in which your personal data will be used. Where consent is required for our use of your personal data as described above, you have the right to withdraw or decline your consent and cease your use of the Services. If you decide to withdraw your consent, such withdrawal will not affect the lawfulness of processing based on consent before such withdrawal.
Except as otherwise set forth in this Privacy Policy, we will not sell, rent, or lease to others your PII or any other personal information we receive from, collect or maintain about you.
As set forth above, if you email us, we may keep your message, email address, and contact information to respond to your message. In certain instances, our response may be provided to third parties as necessary to address certain problems, comments, and requests.
Except as otherwise set forth herein, we employ the Payment Processor (as defined in the Terms of Service) as a payment intermediary service to receive payment from users of the Services, and do not request or store any of your financial information, such as your bank routing or account numbers, or your debit or credit card account numbers.
Following termination or deactivation of your Account (as defined in the Terms of Service), we may retain information, including profile information and PII, in order to comply with applicable law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce our rights under our agreements with you, for backup, audit or regulatory purposes, and for other actions permitted by law.
We may share your PII for marketing purposes. Those uses will be subject to such third party’s privacy policies. Also, we may share your PII with third parties in aggregated and/or anonymized form.
Who We Share Your Information With:
In the course of doing business, we may share your information with third parties with whom we contract to support our activities, including maintaining and managing our end-user information. We may also determine we need to share your information with law enforcement to: (a) comply with the law or with legal process; (b) protect and defend our rights and property; (c) protect against misuse or unauthorized use of the Site; (d) protect the personal safety or property of our users or the public; or (e) in the event of bankruptcy proceedings.
We may share your information with third party service providers who provide services on our behalf. We may employ independent companies or other third parties and individuals to help us provide, facilitate, or improve our Service (such as customer service support). They are permitted to use data only for the purpose of performing services on our behalf or at an aggregate level. Service providers are required to implement reasonable privacy and information protection controls to maintain the privacy and security of information provided to them consistent with the privacy practices outlined in this Privacy Policy. Service providers may include companies that assist us with our advertising, marketing and sales efforts, help us with our technology offerings and help us run our business. Retention of Your Information:
We will only maintain PII in accordance with our data retention policy, which can be found at docs.arcee.ai/policies/data-retention-policy.
Third Party Privacy Practices:
The Site may contain links to websites owned by third parties and third party advertisements. This Privacy Policy applies only to the Site and its content, and our collection and use of information provided through the Site. Your use of third party sites and content may be governed by such third party’s terms of use or privacy policies. Please review any third-party privacy policies before providing your information on any third-party site. We are not liable for or responsible for your use of third party sites or third party content.
Security:
We employ encryption and undertake other security measures to protect all information, including PII, from unauthorized or accidental access, disclosure, misuse or processing, or from alteration, destruction, or loss; however, because no security measures are perfect or impenetrable, we cannot guarantee the security of information you submit to us.
Children’s Privacy:
When it comes to the collection of PII from children under the age of thirteen (13) years old, the Children’s Online Privacy Protection Act (“COPPA”) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under the age of thirteen (13) years old.
As protecting the privacy of young children is especially important, we do not knowingly collect or maintain information from or about persons under eighteen (18) years of age. No part of our Site is structured to attract anyone under eighteen (18). If you are under eighteen (18), do not use or access the Site at any time or in any manner. If we learn that PII of persons under eighteen (18) has been collected on the Site without verified parental consent, we will take appropriate steps to delete this information. Changes to Our Privacy Policy:
We may modify or update this Privacy Policy from time to time to reflect the changes in our business and practices. You should check our websites frequently to see recent changes. When we change the policy in a material manner, we will update the ‘last modified’ date at the bottom of this page. If you object to any changes, you may close your account. Continuing to use our services after we publish changes to this Privacy Policy means that you are consenting to the changes.
California Privacy Rights (for California residents only):
The California Consumer Privacy Act (the “CCPA”) provides certain rights to California residents regarding their PII. The CCPA became effective January 1, 2020, and was amended by the California Privacy Rights Act of 2020 or the effective January 1, 2023 (together with CCPA, “CA Privacy Laws”). The CA Privacy Laws grant California consumers certain rights related to their PII. A California resident has the right to request that we disclose certain information, including: (1) the categories of personal information we have collected about that California resident; (2) the categories of sources from which the personal information is collected; (3) the business or commercial purpose for collecting or selling the personal information; (4) the categories of third parties with whom we share personal information; (5) the specific pieces of PII we have collected about that resident; and (6) the categories of personal information that we have sold about that resident and the categories of third parties to whom that information was sold. A California resident has the right to request that we delete their personal information. A California resident also has a right to “opt-out” of the sale of that resident’s personal information. A California resident has the right not to be discriminated against for exercising their privacy rights under the CA Privacy Laws. A California resident has the right request that we correct inaccurate personal information about the resident. Finally, a California resident has the right to limit our use and disclosure of sensitive personal information about the resident; provided, however, that the CA Privacy Laws do not prohibit us from offering financial incentives, different prices, rates, levels or qualities of goods or services for the collection of personal information if that price or difference is directly related to the value provided by the consumer’s data.
Under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared that information for the immediately prior calendar year (e.g. requests made in 2026 will receive information regarding 2025 sharing activities). To obtain this information, please send an email message to support@arcee.ai requesting us to provide its third-party information sharing disclosures required by section 1798.83 of the California Civil Code. Please also provide your name, address and email address. We will provide the requested information to you at your e-mail address in response. Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response.
Pursuant to California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: California residents may reach the Complaint Assistance Unit of the Division of Consumer Services for the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
European Union General Data Protection Regulation (the “GDPR”) Rights (for European Economic Area (“EEA”) residents only):
The GDPR provides certain rights to EEA residents regarding their personal information. An EEA resident has the right to: (1) know or be notified about the collection and use of their personal information; (2) be provided with a copy of their personal information; (3) require us to correct any mistakes in their personal information; (4) require us to delete their personal information; (5) require us to restrict processing of their personal information; (6) receive the personal information they provided to us, in a structured, commonly used, and machine-readable format and/or transmit the personal information to a third party; (7) object: (a) at any time to their personal information being processed for direct marketing (including profiling); and (b) in certain other situations to our continued processing of your personal information; and (8) not be subject to a decision based solely on automated processing (including profiling) that produces legal effects concerning such EEA resident or similarly significantly affects such EEA resident.
The GDPR entitles EEA residents to lodge a complaint with a supervisory authority, in the EEA state where such EEA resident works, normally lives, or where any alleged infringement of the GDPR occurred.
Brazil General Data Protection Regulation (the “LGPD”) Rights (for Brazil residents only):
The LGPD provides certain right to Brazil residents regarding their personal information. A resident of Brazil has the right to: (1) request confirmation as to whether we process any of their personal information; (2) request we correct incomplete, inaccurate, or outdated personal information; (3) request we anonymize, block, or erase personal information that is unnecessary, excessive or processed in violation of the LGPD; (4) request information on the public and private entities with which such Brazil resident’s personal information has been shared; (5) request information on the consequences for refusing to provide consent; (6) withdraw consent; and (7) request a review of decisions made solely based on automated processing of personal information.
Canada Personal Information Protection and Electronic Documents Act (for Canada residents only):
By using the Services, you confirm you have read, understand and consent to the collection, use, processing, and disclosure of your personal information in accordance with this Privacy Policy. We will only collect, use and disclose your personal information with your consent, unless otherwise permitted or required by law. Your consent may be given expressly or implied, depending on the circumstances and sensitivity or the information involved. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice.
China Personal Information Protection Laws (the “PIPL”) (for China residents only):
The PIPL provides certain rights to residents of China regarding their personal information. A resident of China has the right to: (1) withdraw consent without discrimination against their ability to use the Services; (2) know why personal information is collected, how long it is retained, and how rights can be exercised; (3) opt-out of automated decision making based on personal information; (4) determine who accesses and/or handles their personal information; (5) amend inaccurate or incomplete personal information; and (6) request the deletion of personal information.
International Data Transfers:
If you provide PII to us, we may transfer, process, use, or store such PII in a country other than the country in which it was collected, including the United States or other destinations outside the EEA. Do not provide PII to us if you do not consent to that information being transferred outside of the EEA. Your PII may be transferred to countries that have been deemed to provide an adequate level of protection for PII by the European Commission.
Where there is no adequacy decision by the European Commission in respect of a country (to the extent that they are outside of the EEA), which means it is not deemed to provide the adequate level of protection for your PII, we will ensure your PII receives an adequate level of protection. For example, each such transfer to a third party will be protected by contractual commitments and further assurances (where appropriate) such as the European Commission’s approved Standard Contractual Clauses.
